Course Outline

A one-day in-person workshop introduces the AARTO ACT , the general principles, application of the AARTO Act adjudication process and the points-demerit system to the various role players in each company, business, partnership as well as to the individual road-user.

Session 1: Introduction

To understand:

  • What is the AARTO Act?
  • An introduction to the AARTO Act
  • New rules for AARTO
  • Administrative Law applies to AARTO
  • Differences between the Criminal Procedure- and / AARTO process
  • The AARTO Act as a prosecutorial instrument

Session 2: Traffic violations

To distinguish between:

  • Traffic violation
  • Traffic charges
  • Traffic infringements
  • Traffic offences

Session 3: The AARTO Process

To know:

  • The processes of the AARTO Act
  • The three stages of the AARTO process
  • Service of AARTO notices
  • The infringement notice
  • Options upon receipt of an infringement notice.
  • The courtesy letter
  • Options upon receipt of a courtesy letter
  • The enforcement order
  • Consequences of enforcement letter

Session 4: The points-demerit system

To apply:

  • The points-demerit system
  • Maximum demerit points
  • Accumulation and exceeding maximum demerit points
  • Suspension / cancellation of licence/ driver permits
  • The rehabilitation programme
  • Demerit points associated with common traffic infringements
  • Special provisions applicable to the points demerit system

Session 5: Business Vehicles

To evaluate:

  • Business Vehicles
  • Nominated proxies
  • Duties of proxy
  • Fleet owners
  • Operators
  • Duties of operators and owners permitting any person to drive
  • Advice to employers
  • Fleet management plan
  • Action to be taken by Organisations

Session 6: The Road Traffic Infringement Authority (RTIA)

To describe:

  • The role and objectives of RTIA
  • The AARTO Appeals Tribunal

Session 7: Practical activities

To assess:

  • Practical scenario-based activities
  • Assessment

Certification

On completion of the course, participants will receive a Certificate of Completion.
